Our Personal Bankruptcy Practice
When you retain us to help you get a fresh start through a bankruptcy filing, we will start by thoroughly reviewing your situation, so we can help you determine whether bankruptcy is the best solution and, if so, whether you should seek protection under Chapter 7 or Chapter 13.
Under a Chapter 7, you can completely discharge any obligation to repay certain debts in exchange for the sale (liquidation) of non-exempt assets. Some obligations, such as student loans, child support arrearages and certain taxes, cannot be extinguished in bankruptcy. Likewise, you can exclude certain assets, such as your primary residence and vehicle, from sale in a Chapter 7 proceeding. We will make certain you understand what can be discharged and what can be protected before you decide to file.
The bankruptcy laws changed in 2005, making it more difficult for individuals to qualify to file under Chapter 7. You must now submit to a means test. If the bankruptcy court determines that you have the resources to repay your creditors over a 3 to 5 year period, you will not be allowed to file a Chapter 7 bankruptcy. Your only recourse in bankruptcy will then be under Chapter 13.
In a Chapter 13 bankruptcy, your debts are restructured (reorganized) and you set up new payment arrangements with your creditors, agreeing to satisfy your debts over a 3 to 5 year period. We will carefully review any proposed repayment agreements to make certain they are within your means. If you fail to meet your obligations in a Chapter 13 proceeding, you can lose the protection of the bankruptcy laws, including protection from harassing phone calls, letters and other attempts to collect the debt.
